Booking Fees, Postponements and Cancellations

A non refundable Booking Fee of $1,000, and the completion of this contract, is required upfront to secure the services of Toast Wedding Films.

This sum will be deducted from your final invoice. In the event of a cancellation, regardless of the cause, this Booking Fee will be retained by Toast Wedding Films. This applies even in the event that COVID19 travel restrictions prevent the client from entering the country.

If the booking needs to be rescheduled, the first change of date will be free of charge if it is within 12 months of the original booking date. An additional fee may apply to any further rescheduling.

If the booking is rescheduled, the same price will be honoured if the new date is within the same Wedding Season (Sep 1st – Aug 31st).

If a booking is rescheduled to a date outside of the same Wedding Season, Toast Wedding Films is not obliged to honour the original pricing, and an additional fee may apply.

In the event of a force-majeure situation that prohibits the wedding from going ahead, the Booking Fee will be held to cover costs already accrued by Toast Wedding Films for work done in anticipation of your wedding date.

Final Invoice

The final balance will be due 30 days prior to the wedding date. If this is not paid prior to your wedding date, we reserve the right to cancel our services and your Booking Fee will not be refunded.

Copyright

Definitions:

Completed Media means any and all video and photography files supplied to The Client by Toast Wedding Films. Media means any and all digital or analogue video, film, derivative images, computer generated images and photographs produced by Toast Wedding Films; RAW Files means the original and unedited Media recorded during the provision of the Services; The Client means the couple detailed in this agreement.

Terms of use:

Toast Wedding Films grants a non-exclusive licence to The Client to:

Display or publish the Completed Media through any medium for non-
commercial purposes; Upload, email or electronically transfer the Completed Media; and Use the Completed Media for any personal purposes, provided it remains within the context of the originally intended purpose of the media. For the avoidance of doubt the originally intended purpose of the media was to capture The Client’s wedding day.

The licence granted to the Client does not allow the Client to:
Sell any Completed Media or electronic file supplied by Toast Wedding Films; Make derivative works, or otherwise modify, edit or manipulate the Completed Media except within the context of the originally intended purpose of the media. For the avoidance of doubt the originally intended purpose of the media was to capture The Client’s wedding day.;

Enter the Completed Media in any competition or promotions relating to film, cinematography or videography without prior written approval from Toast Wedding Films.

The Client acknowledges and agrees that all RAW Files, Media, Completed Media and copyrights created or existing (whether before or after the date of this Contract) in connection with the provision of the Services are the property of Toast Wedding Films. Toast Wedding Films may use, display and/or publish any images and/or video at their discretion for marketing, advertising and/or competition purposes.

Re-orders

All re-orders are to be considered an extension of this contract

Prices

All prices mentioned in this contract are in $NZD and include GST unless otherwise stated. Prices include all prep, shooting, editing, colour grading and a fully licensed soundtrack of our choice.

Prices are subject to the Queenstown region only and do not include travel costs outside of this region (More than 30km from the CBD).

Glenorchy Travel fee – $200

Wanaka Travel Fee – $250

For other locations specific Travel Fees will be provided on booking. Coverage is within the wedding date only. Packages and pricing correspond to the information in our brochure that was provided to you prior to booking.

Confirmation

We will notify you once payment of the deposit as outlined above has been received. Our services are not confirmed until this time.

Technical Faults

Weddings are live events and therefore, despite taking every possible precaution to mitigate against technical issues or faults, these cannot be guaranteed against. Toast Wedding Films accepts no liability for the loss of or quality issues relating to any media (video and audio) recorded during the event.

Delivery

The first draft shall be delivered no later than 90 days from the end of the contracted shoot date(s) unless a Same Day Delivery or Guaranteed Delivery Date has been selected in the options above and confirmed by Toast Wedding Films. Final material will be delivered via Google Drive unless otherwise agreed.

Same Day Edit:

The Same Day Edit will be delivered within 24hrs of the end of your event, unless otherwise agreed.

The Guaranteed Delivery Date:

If you have a special event you’d like your film in time for, let us know a specific delivery date that must be a minimum of 7 days after your wedding date. Requests are subject to availability and must be submitted at the time of booking. Your request will be confirmed or declined via email.

Editing + Changes

Toast Wedding Films retains the right to edit the video as they see fit based on our experience and expertise and based upon our style as evident in our published work. We may also omit any footage that does not meet our standards. We will allow for one set of reasonable changes to specific shots or audio that do not impact upon our style as evident in our published work. We reserve the right to refuse changes if it impacts our style. In the event of requests to change the edit based on the appearance of the bride/groom in certain shots, we will remove these shots entirely and lengthen other clips in the film rather than replacing with other material.

Style

This booking is undertaken based on the understanding that the client has seen some of our body of work and recognises the style in which we will produce the final material(s). We want you to choose us because you like our films and want your own video created in the same style. We reserve the right to refuse any requests to shoot or edit in a way that we believe is outside of our style.

Music

Toast Wedding Films retains the right to select the music for the video as they see fit based on our experience and expertise and based upon our style as evident in our published work.

We retain the right to only use music tracks that can be licensed. We reserve the right to refuse changes to the music if it impacts our style.

Helicopters

As a company policy, we will not fly in any Robinson helicopters or with Helicopter Line. If this is booked without our knowledge, we will refuse to fly on the day.

Packages

You have selected specific coverage in the package chosen above. If coverage needs to be extended on the day for any reason, additional hours will be charged to the client at a rate of $495/hr. Additional hours are subject to availability and, if booked in advance, will not be refunded on the day.

Live Streaming

$850 where the ceremony is at a venue with an accessible, reliable internet connection already available. Where this is not the case, price will be assessed on application.

Drone

Aerial video is subject to suitable weather conditions and locations. If you have organised the wedding through a third party planner, please note that aerial video may be subject to approval of their own health and safety policies. It is your responsibility to notify us in advance of the locations for your day so we can approve the use of the drone.

Our Team

Each of our packages specifies the number of team members required for the shoot. We will not send any less staff than is stated. We ask that any coverage lasting more than 6hrs includes food and refreshment for our team but we do not need to be allocated seating with your guests. In fact, this is a nice chance for us to have some time out 🙂 We expect our team members to be treated with respect at all times and any threats or verbally/physically abusive behaviour, perceived or otherwise, towards them will not be tolerated.

In this extremely unlikely event, we reserve the right to immediately cease any work on your film and no refunds will be given.

Weather

We have filmed weddings in glorious sunshine, snowstorms and heavy rain and we’re always able to create incredible films. The weather does, of course, impact certain visuals and our ability to capture certain things. In particular: wind can seriously affect our ability to capture clean audio during your ceremony; wind and rain can affect our ability to fly the drone; rain may affect our ability to capture certain types of shots. We would therefore highly recommend putting some thought into plan-b’s for bad weather situations. We will always attempt to be flexible in the event you wish to move your wedding date due to bad weather. However, this is subject to our availability and we reserve the right to charge a postponement fee.
